Justice Faiz can't hear case against PM: SC

 The Supreme Court has written in its written judgment in the hearing of a case relating to release of funds for development projects to MPs: Can't hear

The five-page decision was written by Chief Justice Gulzar Ahmed and released on Thursday.

The verdict referred to a WhatsApp message received by Justice Qazi Faiz Issa from an unknown source.

Reports got from obscure sources were given to the judges. Copies of these documents were also provided to the Attorney General.

According to the verdict, Justice Faiz Issa said he could not say for sure whether the documents received from an unknown number were genuine or not.

The attorney general said there was a question mark over the authenticity of the documents. The attorney general should not make the petition documents part of the record.

The decision states that the attorney general said that if a judge is a complainant, it is not appropriate for him to hear the case.

The attorney general said it was not appropriate for Justice Qazi Faiz Issa to hear the case.

Chief Justice Gulzar Ahmed said it was not appropriate in this situation for Justice Qazi Faiz Issa to hear the case. "Justice Faiz Issa has also filed a personal petition against the Prime Minister."


Justice Qazi Faiz Issa cannot hear the case against Prime Minister Imran Khan in view of the principle of impartiality and impartial justice.

The decision further said that all the governments, including the federation, have denied the release of development funds.

Earlier, during the hearing of the case, Justice Omar Ata Bandial, a member of the bench, had objected to the court seeking a personal reply from the Prime Minister.

During the hearing, the Chief Justice remarked that the Prime Minister and Justice Faiz Issa were parties against each other in one case.

At the commencement of the hearing in a five-member larger bench headed by Chief Justice Gulzar Ahmed, the Attorney General submitted the report of the Finance Secretary signed by Prime Minister Imran Khan to the Supreme Court.

Attorney General Khalid Javed Khan said that development funds are given to the members of the assembly in accordance with the constitution. The Ministry of Finance oversees the issuance of funds and budget matters.

Justice Faiz Issa revealed during the hearing that "I have received a WhatsApp message. The message contains some documents in which funds were given to a member of NA-65 constituency. These funds were released by PWD. I don't know if these details are true or false. According to the documents, the government coalition was given funds to build the roads.
